Welcome to AIAL — AI Auto Lister ("we," "us," "our"). These Terms of Service ("Terms") govern your access to and use of the AIAL platform at aial.app, including our website, dashboard, API, and any related applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and legally able to enter into a binding contract to use the Service. The Service is designed for eBay sellers and requires an eBay account for full functionality. By using the Service, you represent that you meet these requirements.
To access the Service, you must create an account through our authentication provider, Clerk. When you sign up, we collect your name, email address, and profile image as provided through Clerk. You are responsible for:

AIAL is an AI-powered platform that helps eBay sellers create, manage, and optimize product listings. The Service includes:
The Service offers multiple subscription tiers (Free, Hobby, Starter, Seller, Pro, and Enterprise), each with a monthly AI operation quota and varying feature access. Current plan details and pricing are displayed on our pricing page. We reserve the right to modify plan pricing, quotas, or features with reasonable notice.
All payment processing is handled by Clerk, our authentication and billing provider. AIAL does not directly collect, store, or process credit card numbers or payment method details. Your use of paid plans is subject to Clerk's payment terms. By subscribing to a paid plan, you authorize recurring charges at the applicable rate.
You may cancel your subscription at any time. Upon cancellation, your paid features remain active through the end of your current billing period. After that, your account reverts to the Free tier. We do not offer prorated refunds for partial billing periods.
Each plan includes a monthly quota of AI operations. Usage resets each billing cycle. If you exceed your quota, AI listing generation will be unavailable until your next billing cycle begins or you upgrade to a higher tier.
To publish listings and access eBay features, you must connect your eBay account via OAuth. When you authorize AIAL, you grant us permission to access your eBay account on your behalf within the scopes you approve, which may include:
You remain solely responsible for all listings published to eBay through the Service, including their accuracy, compliance with eBay policies, and any transactions that result. AIAL acts as a tool to assist you — we do not guarantee that AI-generated content will comply with eBay's listing policies or that listings will result in sales.
You may disconnect your eBay account from AIAL at any time through your eBay settings page. Disconnecting revokes our access to your eBay account and deletes your stored eBay credentials from our systems.
The Service uses artificial intelligence to analyze product images and generate listing content. AI-generated output — including product identification, descriptions, pricing suggestions, category classifications, and item specifics — is provided as a starting point and suggestion only. You should always review and verify AI-generated content before publishing.
We do not guarantee the accuracy, completeness, or suitability of AI-generated content. The AI may misidentify products, suggest incorrect pricing, assign wrong categories, or generate inaccurate descriptions. You are responsible for reviewing all content before it is published to eBay or any other platform.
AI-generated pricing suggestions are based on analysis of comparable eBay listings and market data. These are informational estimates only and do not constitute financial advice or a guarantee of sale price. You are solely responsible for setting your listing prices.
If the AI misidentifies a product, you may submit a misidentification report. Reports include your email, a description of the issue, and the AI's analysis data. We use these reports to improve AI accuracy.
You retain ownership of all images, text, and other content you upload to the Service ("User Content"). By uploading User Content, you grant AIAL a non-exclusive, worldwide license to store, process, analyze, compress, and transmit such content solely for the purpose of providing the Service to you. This includes:
Listing content generated by our AI (titles, descriptions, item specifics, etc.) is provided to you as part of the Service. You may use, modify, and publish this content freely. We do not claim ownership of AI-generated listing content created for your account.
The Service, including its design, code, AI models, and branding, is owned by AIAL. Nothing in these Terms grants you rights to our intellectual property beyond the right to use the Service as intended.

To maintain service quality and security, the Service enforces rate limits on API requests. Exceeding these limits may result in temporary throttling. Persistent abuse of rate limits or attempts to circumvent them may result in account suspension.
The Service integrates with and relies on third-party services, including:
Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or conduct of third-party services.
Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read and understand our Privacy Policy.
We implement industry-standard security measures including encrypted data storage, authenticated API access, input validation, and secure credential handling. However, no system is completely secure. You acknowledge that you provide data at your own risk and are responsible for maintaining the security of your own account credentials and connected services.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Our total aggregate liability for any claims arising from the Service shall not exceed the amount you paid to AIAL in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless AIAL, its operators, and affiliates from any claims, damages, or expenses arising from your use of the Service, your User Content, listings published through the Service, or your violation of these Terms or any applicable law or third-party rights.
We may suspend or terminate your access to the Service at any time, with or without notice, for violations of these Terms, abuse of the Service, or any other reason at our discretion. You may stop using the Service and close your account at any time. Upon termination:
